§ 1-16. Administrative agencies, officials defined, and terms pertaining thereto.

  • BOARD OF HEALTH
    The New York State Department of Health or the Canandaigua Town Board convened as a Board of Health pursuant to the provisions of New York Town Law.
    CODE
    The official Town Code entitled "Code of the Town of Canandaigua, County of Ontario, State of New York." Official copies of the Code as may be amended, are maintained and are on file in the Town Clerk's office.
    CODE ENFORCEMENT OFFICER
    The official appointed by the Town Board pursuant to § 92-1 of the Canandaigua Town Code.

    CODE ENFORCEMENT PERSONNEL
    The official(s) appointed by the Town Board pursuant to § 92-1 of the Canandaigua Town Code and shall include the Code Enforcement Officer and all Assistant Code Enforcement Officers.

    CONSULTANT
    The person(s) retained by the Town to provide technical advice, general counseling, or other expertise deemed necessary to enable a Town agency or Town staff to make a determination of significance under SEQR and to permit said agency to make an informed decision upon an application or action.

    CONSULTANT FEES
    Those fees required by a consultant who has been retained by the Town to perform the duties and tasks described in any contract agreement between the consultant and the Town.

    DEPARTMENT OF HEALTH
    The New York State Department of Health and any other health board or department established pursuant to the laws of the State of New York and having authority for the regulation of matters pertaining to the public health of the Town.

    See "Town Planner" for definition of this term.
    ENERGY CODE
    The New York State Energy Conservation Construction Code, as currently in effect and as hereafter amended from time to time.

    INTEREST
    A direct or indirect pecuniary or material benefit accruing to a municipal officer or employee as the result of a contract with the Town of Canandaigua. For the purposes of this Code, a municipal officer or employee shall be deemed to have an interest in the contract of:

    A. 
    His spouse, minor children and dependents, except a contract of employment with the Town of Canandaigua which such officer or employee serves.
    B. 
    A firm, partnership or association of which such officer or employee is a member or employee.
    C. 
    A corporation of which such officer or employee is an officer, director or employee.
    D. 
    A corporation, any stock of which is owned or controlled directly or indirectly by such officer or employee.
    MUNICIPAL OFFICER or EMPLOYEE
    Any municipal officer, employee, agent or representative of the Town, whether paid or unpaid, elective or appointed, including but not limited to the members of the Town Board, Planning Board, Zoning Board of Appeals, committee, administrative board, commission or other agency thereof and any consultant employed by the Town. No person shall be deemed to be a "municipal officer or employee" of the Town solely by reason of being a volunteer fireman or civil defense volunteer, except a Chief Engineer or Assistant Chief Engineer.

    NEWS MEDIA
    A newspaper that is printed not less frequently than once a week in which legal notices may be published, or a radio or television station that regularly broadcasts news.
    NOTICE
    Means, but shall not be limited to, written or oral information relating to the date, time and place where a meeting is to be held.

    The Planning Board of the County of Ontario.
    PLANNING BOARD, TOWN
    The Planning Board of the Town of Canandaigua.

    POLITICAL PARTY OFFICE
    A leadership position within an established political party, which includes but is not limited to Party Chairperson, Vice Chairperson, Secretary or Treasurer. The term does not apply to general or committee membership within an established political party.

    PUBLIC SANITARY SEWER
    A system of inlets, pipes and other improvements operated by a municipality for the conveyance and treatment of sewage.

    SEWAGE
    Water-carried wastes, not including stormwater, surface water, industrial and other wastes, from residences, businesses, industries, institutions, and all other similar establishments.

    SITE DESIGN AND DEVELOPMENT CRITERIA
    A manual of requirements and minimum standards that shall be applied to all proposed construction and/or development in the Town of Canandaigua, and/or areas that will involve the connections to existing municipal systems over which the Town has jurisdiction. Said manual as prepared by the Town's Engineering Consultants, and as adopted by the Town Board, and as may be amended from time to time, may be obtained from the Town Clerk.

    The official duly elected to the position of Town Clerk of the Town of Canandaigua.
    TOWN ENGINEER
    The representative of the engineering firm appointed by the Town Board to serve as engineer for the Town of Canandaigua.
    TOWN HIGHWAY AND WATER SUPERINTENDENT
    The official elected to the position of Town Highway and Water Superintendent for the Town of Canandaigua.
    TOWN MANAGER
    The official appointed by the Town Board to serve as chief administrative officer of the Town of Canandaigua pursuant to Chapter 69 of the Canandaigua Town Code.

    TOWN PLANNER
    The official appointed by the Town Board to serve as planner for the Town of Canandaigua.
    TOWN WATER DEPARTMENT SUPERINTENDENT
    The official appointed by the Town Board to serve as the administrator of the Town of Canandaigua Water Department.
    ZONING BOARD OF APPEALS, TOWN
    The Zoning Board of Appeals of the Town of Canandaigua.
    ZONING CODE, TOWN
    The Zoning Law of the Town of Canandaigua.
    ZONING ENFORCEMENT OFFICER

    The official designated by the Town Board to enforce the applicable provisions of the Town Code.
